How do I get the diminished value of my car after an accident?
An auto accident can significantly diminish the value of your vehicle and if the car accident was not your fault, you most likely are entitled to recovery of your vehicles diminished value. I take diminished value claims on a contingency fee based agreement. A contingency fee based agreement means if I do not get you any money then you do not owe me any money. Diminished value is the amount your automobile was worth before the accident, after it has been repaired to as new condition. In other words, it is the resale value of your vehicle after the accident. Diminished value is a property damage claim.
Even if a mechanic has totally repaired your vehicle to as knew condition, your vehicle is still worth less then it was before the accident because of things like car fax or other accident records. I have put together several claims for diminished value. If the accident was not your fault you should not be responsible for paying for the loss in resale value. As a general matter insurance will most likely cover your diminished value claim because courts, when it comes to property damage, will put the plaintiff in the position they were in before the accident occurred.
The cases I have settled as a Car Accident Lawyer have been cases where the client was injured or not injured. The bodily injury of the person not at fault is completely separate and a different claim from the property damage claim. This is because property damage though relevant to the facts of a case, is a separate matter from any bodily injury case. If you have been in an auto accident, you should call me for your free consultation (434) 660-9701.
When putting together a diminished value claim you will most likely want the assistance of an experienced Car Accident Lawyer like me. I have experience suing the insurer in court for not paying a diminished value claim. I put together an eloquent package for the insurer and they still didn’t want to be reasonable with any diminished value claim offer so, I sued them. If you have a diminished value claim you should call me, I am confident I will most likely be able to help you. I have even gotten recovery for clients with motorcycle diminished value claims. One of my clients was in a motorcycle accident, while riding a brand new motorcycle. For those of you that know motorcycles know that when a brand new bike gets laid down, the value drops drastically. Even if the bike is fully repaired to as new condition. The bikes motorcycle crash report will always show that the bike has been in an accident and most buyers are reluctant to purchase a motorcycle that has been in an accident unless the price is significantly reduced.
