How the police report affects your car accident claim.




For most car accidents, a police report is generated by the responding police officer. Typically, the police report is the primary means of determining liability. However, quite often further investigation is needed. When a Police Officer shows up to the scene of an accident they usually write it up how they see it. Sometimes, its not accurate and further investigation is needed. For example, one of my clients were in a car accident, at first impression it appeared that the facts were unfavorable to my client and the fine officer wrote the police report in a manner the put fault on my client. Fortunately, my client called me, a dedicated car accident lawyer whom investigated further.

At first glance I saw how the officer came to their determination however, after canvassing the area for witness’s we were able to find a witness that viewed the accident differently. Our fine civil servant Police Officers have long days that are very busy and can only spend a certain amount of time on each case. The witness had been working at the same corner the car accident took place on. The witness had a front row seat to what actually happened, that the other vehicle was at fault. This was important because my client had serious injuries and would not have been compensated for his injuries had we not done further investigation. In the Car accident, the good officer wrote in the police report that the accident occurred in a manor that my client had caused the accident when in fact the other vehicle had ran a red light at an intersection.

Why this is important is because liability is usually determined from the police report. Liability is how we determine who is “at fault.” In other words, the at fault person will usually get the damages assigned to their insurance policy. This in turn will generally mean that the at fault person will see an increase in their car insurance premiums. This has two implications, one is that they are the ones that pays for the accident and two an increase in car insurance premiums will generally act as a deterrent to negligent driving. If someone that is a negligent driver sees a monthly increase in their bills, it may make them think twice before they decide to drive negligently.
