Do I have a Car Accident Claim for Compensation?

To determine if you have a claim for compensation resulting from a car accident their are several that I evaluate. Please note that the following is not all inclusive but a general overview. When someone is involved in a car accident their are a variety of factors that we most certainly do not have the time to discuss within this article and therefore there is no way this can be all inclusive. There is a reason that lawyers go to law school for years before being able to represent a client in a car accident.

Who Is At-Fault?

The facts of the accident is a significant factor that I examine closely for every person that calls and requests a free consultation. The facts of the accident is essentially how did the accident happen. This can mean a variety of different things. Usually, I start my due diligence with the police report. The police report will include an investigation by the responding officer. The Officer that came to the scene will typically do a write up of the events that took place and the result of their investigation. However, that is not the only factor determining liability. I have canvassed the area after the accident to find witnesses that the local authorities may not have been able to locate. This includes, people that were working near by that accident that witnessed exactly what happened.

What Insurance Policy Available?

After the accident, typically one of the first things I as a Car Accident Lawyer will do is send an insurance policy request letter to all of the applicable insurance carriers. This will usually tell me how much coverage is available for a given accident. The amount of coverage is important to know so that all parties involved can properly evaluate the accident and the level of liability.

How Much Are Your Damages?

Another factor and a highly important one is how much the bodily injury and property damages are. One accident claim I negotiated and settled for $139,000.00 only had $330.00 in property damages. The amount of damages typically indicate how much the case will settle for. However, the damages can also be fact related. One case I have only had $5,000.00 in medical bills but settled for $100,000.00 because the at-fault driver was suspected of driving under the influence of alcohol. This mean punitive damages became applicable.
