Fatality in District of Columbia Pedestrian Accident



On November 19, 2020, Latoya Sommers was fatally injured in a pedestrian motor vehicle accident. Detectives with the major crash investigation unit of the metropolitan police department determined that the departed was not in a crosswalk at the time of the collision. Once called to the collision Emergency Medical Services transported Latoya to a nearby hospital. Shortly thereafter she was pronounced dead.

During the investigation, Metro police determined that the Mercedes-Benz was traveling northeast in the 1300 block of Southern Ave, S.E. While traveling on the aforesaid direction and street the Mercedes-Benz struck Latoya. Our hearts and prayers go out to the Sommers family for their loss.

As a general matter, a pedestrian will most likely have a claim when struck crossing the street. If a pedestrian is struck while crossing the street in a cross walk and is killed, then the family of the pedestrian would have what is known as a wrongful death claim against the insurance policy. A wrongful death insurance claim is when the family of a person killed as a result of negligence is seeking compensation for the loss. Every person, for the most part, has a value of what their life is worth. The monetary value of their injury or death as calculated by what a jury would most likely return a verdict for. It is a hard truth however, that people like a homeless man killed in an auto accident will glean little compensation to the family for their loss then another person who was not homeless and contributed significantly to their loved ones.
