A common issue after a car accident is dealing with a damaged vehicle. As a general matter, when a client calls me and has a car accident claim, I first see if I can help them obtain medical treatment. Secondly, I get their vehicle addressed as quickly as possible. Because I understand that a car, at least in most parts of the Country, is an integral part of our lives. What happens to your vehicle after a car accident is dependent on the level of damage to the vehicle. Whether or not the vehicle was declared a total loss is an important determination. In any event, I also move the process along to get clients in rental vehicles after an accident quickly.

What If My Car Is Repairable After A Car Accident?

After an accident, the repair shop will determine if your vehicle is repairable. If your vehicle is repairable then your car will most likely be fixed and returned to you. Sometimes, it is best to go through your own insurance to get the repairs done quickly. After the repairs are done your insurance will then submit what is known as a "subrogation Package" to the at-fault parties insurance. The subrogation package essentially bills the at-fault parties insurance. Sometimes, if the at-fault parties insurance accepts liability immediately then you can go through them for the repairs.

Either way, after your vehicle is repaired to pre-crash condition you will most likely have what is known as a Diminution in Value Claim. The Diminution in Value Claim is a lost resale value claim. In other words, the market value your vehicle has lost after an accident, after it has been fully repaired by the repair shop.

What If My Car Is Totaled In A Car Accident?

If your vehicle is totaled in a car accident then typically the at-fault parties insurance will cover the loss. If your vehicle is financed then the insurance company will usually pay the financier. This is because they are the entity that holds the title to your vehicle.
