Lawn Mower vs. 60 miles per hour car

 Earlier this year I secured a bodily injury settlement of $35,000.00 for a client that had been struck by a vehicle while on his lawn mower. My client was riding his lawn mower when a small sedan hit him going approximately 60 mph. Fortunately, he survived and that is the true success story with this case.



The small sedan driver had bodily injury policy limits of $10,000.00. In other words all of the insurance money available from the insurance coverage the driver had was $10,000.00. In Florida the minimum coverage, which is what most drivers have their, is $10,000.00.

My client however, had $300,000.00 in UM policy limits. A UM policy is an Underinsured/Uninsured motorist policy that essentially kicks in if you get into an accident with someone that does not have enough coverage or any coverage. UM polices are highly advised as they provide additional protection in the event of an accident.

My client had huge medical bills in the amount of $60,000.00 plus. Most of his medical bills were covered by his health insurance. The case went to litigation as the insurer did not want to pay the full policy limits in light of the significant injuries.

Unfortunately, witness testimony in the case turned out to not be favorable. The emergency medical technician testified that my client admitted to drinking while on his lawn mower. Other unfavorable factors included the fact that the accident happened at night and my client did have any reflective gear on nor lights on his lawn mower. The driver of the sedan was a civil servant and testified that my client was in the middle of the road on his lawn mower at the time of the accident. The oil spots from the collision were also in the middle of the road indicating the impact occurred in the road. In any event, my client decided to take the settlement offer in lieu of litigating the case further.
