Pedestrian Wrongful Death Case

 A pedestrian is someone traveling by foot. This is typically thought of as a person walking along a sidewalk or jogging. I have represented the families of deceased loved ones whom were killed in pedestrian car accidents. One of my clients family member was walking across the street when a car traveling approximately 55 miles per hour struck him and killed him. He was declared dead on arrival at the hospital.

In the United States, a pedestrian typically always has the right of way. When a vehicle strikes a defenseless pedestrian the impact usually results in serious injury. Pedestrian Fatalities in the Commonwealth ranged from 78 to 121 per year from 2013 to 2016.

Some preventative measures that can be taken by pedestrians are:

  1. Wearing reflective gear at night.
  2. Using sidewalks especially when they are available.
  3. Staying to the side of the road, well away from the lane of travel, when sidewalks are not available.
  4. Taking careful watch for motor vehicles.
